The fact is that the height of the ceilings, unlike the square footage of the apartment, is not specified in the equity participation agreement (EPA) or other document designed to regulate the relationship between the developer and the shareholder. This is quite logical: the cost of an apartment is determined based on its footage, not cubic capacity, so the height of the ceilings is usually not mentioned in official papers. Regarding the footage, the contract also always indicates that it is not final and will be clarified after the delivery of the house based on BTI measurements. Thus, if after delivery it turns out that the area of ​​the apartment is less than what was paid for under the DDU, the developer will return the overpaid money to the buyer. You should not blindly believe the sweet promises in advertising brochures - it is better to find out from the developer personally what exactly he means when talking about three-meter ceilings. But this still does not guarantee anything: if the height of the ceilings is not included in any official document - an agreement, additional. agreement, etc. – it will be impossible to prove anything in the future.

It happens that the height of ceilings is not indicated in project declarations, or they are first indicated, and then removed or rewritten, without notifying buyers about the changes that have occurred in the document. This is also difficult to deal with, since the law allows builders to change the design declaration unilaterally. There is only one consolation: it is unlikely that the developer will make ceilings lower than the 2.5 m established by SNiPs - this contradicts building regulations and rules.
